Federal and state wage and hour laws provide powerful legal rights for many types of workers. The laws require minimum wages and overtime to be paid; and generally, wage and hour claims involve back-pay and timing issues (related to donning and doffing and meal break claims), questions as to misclassification of workers as “exempt,” and class action issues. The statutes often provide for attorneys fee awards for prevailing plaintiffs. The federal and state statutes can be used in a class action setting. The Wage and Hour Litigation Group was formed in 2009 and addresses the needs of attorneys handling employment rights litigation under the Fair Labor Standards Act (FLSA) and state wage and hour statutes. The multiple statutes and jurisdictions dictate the need for coordinated efforts by plaintiff attorneys. Group members network and discuss legal cases and strategies on the Group’s list server and at regular meetings, including AAJ Conventions and Education seminars. The Wage & Hour Litigation Group Document Library is another member benefit, where Group members can search for court documents, briefs, depositions, and more.

  • Meetings: The group meets at the AAJ Annual and Winter conventions.
