Proposed Amendment to Substitute "Neutral" for "Master" in Federal Rules

Informal AAJ Comment

Sept. 10, 2024

In February 2024, the American Bar Association (ABA) submitted proposals to substitute the term “court-appointed neutral” for “court-appointed master” within FRCP 53, FRBP 9031, and other federal rules that reference potentially appointing a “master.”

AAJ President Lori Andrus and Minority Caucus Chair Christopher H. Fitzgerald filed a joint letter in support of the ABA proposal in September 2024, urging the Advisory Committee of Civil Rules to consider the use of more neutral terminology in civil litigation.
