Inadequate hydration
November/December 2024Jeffery Birchmore, a 76-year-old man who suffered from dementia, resided at Langhome Gardens Health & Rehabilitation. His daughter found him unresponsive one day and requested that he be taken to an ER. He was transferred to a hospital, where he was diagnosed as having a UTI, dehydration, and sepsis. A physician allegedly determined that he had a fluid deficit of 7.8 liters when he was discharged from the nursing home. Birchmore died three days later. He is survived by his five adult children.
Birchmore’s estate sued operator Saber Healthcare Group, LLC, and others, alleging claims for professional, ordinary, and corporate negligence. The plaintiff asserted that the defendants failed to provide for Birchmore’s basic needs, including adequate food and hydration.
The parties settled for $130,000.
