Failure to maintain wheel

Motorists John Haislip and Katrina Ormsby were injured in a crash that resulted when a wheel came off a truck driven by an alleged employee of Monze Enterprises and/or Seven Corners Logistics, Inc. Haislip required a one-level lumbar fusion surgery, and Ormsby underwent shoulder injections to treat a connective tissue injury.

Haislip and Ormsby sued Monze Enterprises, Inc.; Seven Corners Logistics, Inc.; and the truck driver, alleging failure to maintain the wheel, which was heavily rusted. The plaintiffs also asserted a claim for spoliation of evidence. They did not claim lost income or past medical expenses.

The defense did not admit liability but reportedly acknowledged that the wheel should not have come off.

The parties settled for $950,000.
