Failure to heed traffic control device

January 2025

Yoon Yong Lim was driving a vehicle with Gisook Lim in the front passenger seat. As they drove through an intersection on a green light, Sandipani Paduchuri allegedly ran a red light and crashed into the driver’s side of the Lims’ vehicle, causing it to spin and collide with the rear of Paduchuri’s vehicle. The Lims suffered severe injuries.

They sued Paduchuri, alleging she failed to obey a traffic control device, keep a proper lookout, and drive attentively. The plaintiffs also named Safeco Insurance Co., alleging breach of contract for the insurer’s failure to pay policy limits on an underinsured motorist policy.

The jury awarded approximately $1.06 million.

Citation: Lim v. Paduchuri, No. 21SC-0897-B (Ga. St. Ct. Forsyth Cnty. Aug. 1, 2024).

Plaintiff counsel: Yari D. Lawson, Lawrenceville, Ga.; and Joon Jeong, Suwanee, Ga.
