Speeding, crossing center line

December 12, 2024

Patrick Bowes Jr. was driving a pickup truck on a northbound roadway. He was speeding and weaving in and out of traffic before crossing the center line and colliding with a vehicle operated by Gary Weiner. Weiner, who was in his early 60s, suffered a traumatic brain injury, lung contusion, torn rotator cuff, and rib fractures, among other injuries. He required hospitalization and underwent orthopedic surgery. Additionally, he received inpatient rehabilitation, plus physical and occupational therapy. An aviation maintenance technician earning more than $1,400 per week, he is unable to continue working.

Weiner sued Bowes, and, after his death, his estate, alleging negligence.

The court awarded $2 million.

Citation: Weiner v. Norton, No. 2283CV00390 (Mass. Super. Ct. Plymouth Cnty. Aug. 12, 2024).

Plaintiff counsel: Robert W. Norton and Roger J. Donahue Jr., both of Quincy, Mass.
